Does Florida Have a Business Income Tax?

Florida has no personal income tax, but it does have a corporate income tax. Whether your business owes it comes down to one thing: how your entity is taxed federally. C corporations generally owe it. Pass-through entities generally do not.

The confusion is understandable. “Florida has no income tax” is repeated so often that owners assume it means no state tax of any kind on business profit. It does not.

Notice that the entity type on your formation paperwork is not what decides this. An LLC can land in either row depending on how it elected to be taxed. That election is the thing that matters.

The part people miss: filing is not the same as owing

There can be a Florida filing obligation even in years where no tax is due, and even for some entities that end up owing nothing. Owners who reason “we owe nothing, so there is nothing to file” sometimes accumulate unfiled years without realizing it.

Unfiled returns are a much easier problem to fix early than late, and they have a way of surfacing during a sale or a financing application.

So what does my Florida business actually pay?

For most small businesses down here, the state-level obligations that actually cost money are not income tax at all:

Meanwhile your federal obligation is unchanged by any of this. Florida not taxing your personal income does not reduce what you owe the IRS.

Does this change how I should structure the business?

It is one input, not the deciding one. Because Florida does not tax pass-through income at the entity level, the state-tax argument for avoiding C corporation status is stronger here than in most states. But the structure decision turns mostly on federal treatment, payroll, your plans for the business, and what you intend to do with the profit.

Does Florida tax LLC income?
Not at the entity level for an LLC taxed as a disregarded entity, partnership, or S corporation. An LLC that elected to be taxed as a corporation is treated as a corporation for this purpose.

Do I have to file a Florida return if I owe nothing?
Possibly. A filing obligation can exist independently of whether tax is due. Check your specific entity type rather than assuming.

Does Florida tax my personal income from the business?
No. Florida has no personal income tax. Your profit is still taxable federally.

Is Florida actually a low-tax state for business?
On income, yes, relative to most states. Sales tax, reemployment tax, tourist development tax, and local receipts still apply, so the total picture is more than the income tax headline suggests.
